Overview
These Terms of Service govern your access to and use of tinygraceuk.com and purchases made through the Tiny Grace online store.
Throughout these Terms, the terms “we”, “us” and “our” refer to Servei Nariu NAKOVE, trading as Tiny Grace.
By accessing our website or placing an order with Tiny Grace, you agree to these Terms of Service. These Terms apply alongside our Privacy Policy, Shipping Policy and Return and Refund Policy.
Nothing in these Terms is intended to exclude, restrict or otherwise affect any statutory rights that cannot lawfully be excluded or restricted under applicable UK consumer law.
1. Online Store
Tiny Grace operates an online retail store primarily serving customers in the United Kingdom.
Our products are sold online through tinygraceuk.com, which is powered by Shopify.
You must be legally capable of entering into a binding contract to place an order. Where an individual is under the age required to enter into a contract, an order must be placed by or with the involvement of a parent or legal guardian.
2. Products
We make reasonable efforts to describe and display our products accurately.
Product photographs are provided for illustrative purposes. Colours and appearance may vary slightly depending on lighting, photography and the screen or device used to view the website.
Product availability may change without notice.
We reserve the right to discontinue products or modify our product range, provided this does not affect orders for which we have already entered into a binding contract with you, except where permitted by applicable law.
3. Prices and Currency
Prices displayed on Tiny Grace are shown in British pounds sterling, GBP (£) unless clearly stated otherwise.
The price applicable to an order will be the price displayed during checkout when the order is submitted, subject to correction of obvious pricing errors as permitted by law.
Any applicable charges presented during checkout will be shown before you submit your order.
4. Orders
When you submit an order, you are making an offer to purchase the products contained in that order.
Receiving an automated order confirmation does not necessarily mean that we have accepted your order where further payment, fraud or availability checks are required.
A contract is formed when your order is accepted in accordance with our checkout and order processing procedure.
We may refuse or cancel an order where reasonably necessary, including where:
- Payment cannot be authorised.
- Information provided with the order is materially incomplete or incorrect.
- We reasonably suspect fraud or unauthorised payment activity.
- A product is unavailable.
- There is an obvious pricing or product information error.
- We cannot lawfully fulfil the order.
Where we cancel an order after payment has been collected, we will arrange an appropriate refund to the original payment method.
5. Payment
Payment must be made using one of the payment methods available during checkout.
Payments may be processed by Shopify or third-party payment service providers.
You agree to provide current, complete and accurate billing and payment information when placing an order.
You confirm that you are authorised to use the payment method submitted with your order.
The transaction descriptor appearing on your card or payment statement may appear as TINY GRACE, or in another format determined by the relevant payment processor, bank or card issuer.
6. Order Processing
Orders are normally processed within 1 to 3 business days.
Processing time refers to the period required to prepare an order for dispatch and is separate from the estimated delivery period.
Orders placed on weekends, public holidays or outside normal processing periods may begin processing on the next applicable business day.
7. Shipping and Fulfilment
Tiny Grace uses a third-party supplier located in China to fulfil orders.
Products are therefore shipped directly from China to the customer rather than first being delivered to our Australian registered business address.
Estimated delivery is 8 to 16 business days after dispatch.
Where an order contains multiple products, products may be dispatched separately and may arrive in different packages or on different dates.
Further information is provided in our Shipping Policy.
8. Customs and Import Charges
International shipments may be subject to customs procedures, import duties, taxes or other charges imposed by authorities in the destination country.
Where such charges are not collected during checkout and are lawfully payable by the recipient, they are the customer's responsibility.
Customs processing may occasionally affect delivery times and is outside our direct control.
9. Delivery Information
You are responsible for providing complete and accurate delivery information when placing an order.
Please contact help@tinygrace.com promptly if you notice an error in your delivery details.
We cannot guarantee that an address can be changed after an order has entered processing or been dispatched.
Nothing in this section affects any responsibility that cannot lawfully be excluded under applicable consumer legislation.
10. Returns and Refunds
Refund requests are governed by our Return and Refund Policy and applicable UK consumer law.
Customers may contact us at help@tinygrace.com within 30 days from the date of delivery to request a refund under our stated policy.
Where a refund is approved under our policy, Tiny Grace does not require the customer to physically return the product.
After approval, the customer may keep or responsibly dispose of the item in accordance with the instructions provided by Tiny Grace.
Approved refunds are issued to the original payment method. Depending on the customer's bank, card issuer or payment provider, it may take approximately 5 to 10 business days for the refund to appear after processing.
11. UK Consumer Rights
Nothing in these Terms affects your mandatory rights as a consumer under applicable UK law.
Depending on the circumstances, relevant legislation may include the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Where applicable, consumers purchasing eligible goods online generally have a statutory 14-day cancellation period, beginning in accordance with applicable UK legislation.
Tiny Grace's policy of waiving physical returns for approved refunds or cancellations does not reduce any statutory rights available to customers.
12. Faulty or Misdescribed Products
Goods supplied by Tiny Grace are subject to applicable statutory requirements concerning quality, fitness for purpose and conformity with their description.
If you believe that an item is faulty, damaged, incorrect or materially different from its description, contact help@tinygrace.com with your order details and, where appropriate, photographs showing the issue.
Any remedies provided under our policies operate in addition to mandatory consumer rights.
13. Website Accuracy
We make reasonable efforts to ensure that information published on tinygraceuk.com is accurate and current.
Occasional typographical, technical or administrative errors may occur.
Where we identify an error affecting an order, we will take reasonable steps to inform the affected customer and provide any options required under applicable law.
14. Prohibited Use
You must not use our website:
- For unlawful or fraudulent purposes.
- To violate applicable laws or regulations.
- To infringe intellectual property or other legal rights.
- To transmit malicious software or harmful code.
- To interfere with the security or normal operation of the website.
- To attempt unauthorised access to systems, accounts or information.
- To submit false, deceptive or fraudulent information.
- To engage in payment fraud or abuse our ordering or refund processes.
We may restrict access to the website where reasonably necessary to protect Tiny Grace, our customers, our service providers or other users.
15. Intellectual Property
Unless otherwise stated, the content created for Tiny Grace and published on tinygraceuk.com, including our branding, website text, graphics and other original materials, is owned by or licensed for use by Tiny Grace.
Third-party trademarks, product names, images or other intellectual property remain the property of their respective owners.
Nothing in these Terms grants you ownership of intellectual property belonging to Tiny Grace or any third party.
16. Third-Party Services
Our store relies on third-party services, including Shopify, payment processors, logistics providers, analytics services and our fulfilment supplier.
Certain links on our website may direct you to third-party websites.
Third-party services and websites may operate under their own terms and privacy policies.
Nothing in this section excludes responsibility that Tiny Grace has to consumers under applicable law for the performance of its contractual obligations.
17. Personal Information
Personal information submitted through Tiny Grace is processed in accordance with our Privacy Policy and applicable UK data protection legislation.
For privacy enquiries, contact help@tinygrace.com.
18. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, nothing in these Terms is intended to exclude or restrict liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or restricted.
Your statutory rights as a consumer remain unaffected.
19. Events Outside Our Reasonable Control
We will not be responsible for delays or failures caused by circumstances outside our reasonable control to the extent permitted by law.
Such circumstances may include significant transport disruption, customs delays, natural disasters, industrial action, governmental restrictions, widespread telecommunications failures or other events that could not reasonably have been prevented.
Where such an event materially affects an order, we will take reasonable steps to minimise its effect and comply with any obligations imposed by applicable consumer law.
20. Changes to These Terms
We may update these Terms of Service from time to time to reflect changes in our business operations, services, technology or legal obligations.
Changes will apply from the date the updated Terms are published on tinygraceuk.com and will not retrospectively remove contractual or statutory rights already acquired by customers.
21. Governing Law
These Terms and contracts entered into through Tiny Grace are subject to applicable law.
Because Tiny Grace sells to consumers in the United Kingdom, nothing in these Terms is intended to deprive a UK consumer of mandatory protections available under the laws applicable to them.
Any dispute may be brought before a court having jurisdiction under applicable consumer and private international law.
